PURPOSE

 

To provide guidance in hiring faculty or staff members from outside of the United States.

 

APPLICABILITY

 

All Full-Time Faculty and Staff, excluding those with one-year term contracts.

 

POLICY

 

When in the University’s interest, in situations where a temporary working visa is necessary for any full-time faculty or staff members, the University will be responsible for coordinating the application process associated with applications for H-1B and TN statuses.  When in the University’s interest, the University will be responsible for coordinating applications for Permanent Residency status for any tenure earning faculty.

 

Under these circumstances, the University will be responsible for coordinating and covering all normal legal and filing costs associated with the applications for H-1B status for any full-time faculty or staff members, as well as Permanent Residency status for any tenure earning faculty and TN status coaches.

 

The University does not cover any costs associated with obtaining the physical examination required by the United States Citizenship and Immigration Services in obtaining permanent residency.

 

If the employee (full-time staff, term or tenure earning faculty) chooses to terminate employment with the University, within the first two years of employment, the University will require that the employee reimburse the University for all legal and filing costs incurred by the University associated with obtaining the H-1B, TN status or permanent residency for the faculty or staff member.

 

This policy covers only the NMU employee and excludes the employee’s family members.  Any visa or residency status costs for the employee’s family members would be the responsibility of the employee or his/her family members.  This policy does not apply to students and their dependents.
